The file(s), further referred to as "Software" that represent or accompany this publication are the property of Quality Works and are protected by national copyright laws, by laws of other countries and by international treaties. While Quality Works continues to own the Software, you have certain rights to use the Software after your acceptance of this License Agreement. Quality Works reserves all rights not specifically granted to you hereunder. Quality Works does not convey any intellectual property rights to you hereunder, but grants you a license to use the Software and documentation under the terms of this Agreement. Your rights and obligations with respect to the use of this Software are as follows:

You may:

• Use one copy of the Software installed on a single computer or workstation;

• Access the registered version of Software through a network, provided that you have purchased individual licenses for the Software for all workstations that will access the Software through the network, regardless of whether they use Software at different times or concurrently. If the Software is purchased for a company's use, one copy of the Software for each user may be used on a single home personal computer;
  Make one copy of the Software for archival purposes, or copy the Software onto the hard disk of your computer and retain the original for archival purposes;

• Make one printed copy of the book per license;

• Transfer the Software on a permanent basis to another person or entity, provided that you retain no copies of the Software or the book itself and the transferee agrees in writing to be bound by the terms of this agreement. Such a transfer terminates your license;

• Make changes to the files to document your company's quality system and modify or translate the Software or documentation as necessary only for the purpose of creating one copy of a custom Quality Manual and documents included in the Software for your organization

You shall not:

Copy the Software or documentation except as permitted above;
Loan, sublicense, rent or lease any portion of the Software or documentation or otherwise transfer or assign the right to use them, except under the conditions permitted above;
Remove Quality Works' copyright or restricted rights notices from any whole or partial original copies of the Software or documentation.

Limited Warranty:

Quality Works warrants that the Software and documentation you download or receive will be a complete copy of the Software and documentation described on Quality Works' Website. Your sole remedy in the event of a breach of this warranty is that Quality Works will, at its option, replace such copy of the Software and documentation or refund the money you paid for the Software and documentation. Quality Works does not warrant that the Software will meet your requirements.

THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

Limit of Liability and Disclaimer of Damages:

In no event will Quality Works be liable for any incidental, consequential, indirect or similar damages, including any lost profits or lost data arising out of the use of or inability to use the Software or documentation, even if Quality Works has been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In no case shall Quality Works' liability exceed the purchase price of the Software.

General:

This Agreement will commence upon initial installation or download of the Software and shall continue in effect for so long as the Software is protected by copyright. Nonetheless, this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination or expiration of this Agreement, you must (i) discontinue your use of the Software and documentation, and (ii) permanently erase or destroy all copies of the Software and documentation.

The laws of the State of Colorado will govern this Agreement. This Agreement may only be modified by an addendum that has been signed by an authorized representative of Quality Works
